Operation of MinBids services MinBids reserves the right to cancel or withdraw listings, to close transactions which are conducted through MinBids early, to extend them, or to terminate entire services, where we have compelling legal or technical reasons to do so (including technical difficulties experienced by MinBids, Members or the Internet). Where practical, we shall provide reasonable advance notice to Members of any such steps MinBids is to take. There may also be times when this site, or others through which MinBids services are offered, become unavailable, whether on a scheduled or unscheduled basis. Placing Bids By placing a bid on an item(s) listed on MinBids, you are stating that you have the ability and intention to purchase the item for the amount of your bid, should the auction end and you are the high bidder. In the case of a reserve auction, if your bid meets or exceeds the Seller’s stated reserve price, you agree to purchase the item(s) for the amount of your winning bid. Before placing a bid in an auction, you should be certain you understand all terms and conditions of the sale as indicated by the Seller. Placing a bid is considered a legal, binding contract in most countries and states. If you have any questions about an item, or the Seller offering the item, you should ask the Seller before placing your bid. Only in certain situations is bid withdrawal acceptable. These situations may include: The Seller has made material changes to the description of the item after your bid was placed The Seller has made a typographical or numeric error in the description or price of the item You have contacted the Seller and received their express permission to withdraw your bid Bidders may not engage in the following activity: Bidding in a manner that causes the maximum bid or the Proxy bid of other Bidders to be revealed, then retract your high bid, and bid again at a lower increment above the true high Bidder Placing bids for the purpose of exposing the Sellers reserve price, then retracting your bid and bidding again later with a secondary User ID Bidding on any item that you do not have the intention or means to purchase at the close of the auction, should your high bid cause you to win the auction. Fees and Charges The Seller agrees to pay to MinBids the fees we specify for listings, for their promotion on the MinBids site (if such promotion is requested by the Seller including featured item listings, attention grabbers, bold listings, etc), and for sale, exchange or wanted transactions. Fees payable for listings or promotional features will not under any circumstances be rebated or refunded to the Seller. All payable amounts will accrue monthly and will be automatically debited to your Membership account. Sellers will be sent an invoice monthly via email showing their account status and containing the request for payment. If the Seller does not pay fees within 15 days after payment request has been made, we may suspend or terminate (at our discretion) all MinBids services provided to them; and/or we may charge late payment fees and additional collection costs of £10 – collected in the Seller’s nominated currency. You acknowledge and agree that MinBids is entitled to alter the fees amount or the basis of the calculation of its fees from time to time, provided that such amount or basis is clearly stated at the time when the relevant Listing is created. We may, from time to time, add new or ancillary services which require the payment of fees - either to us or a nominated third party - on terms which will be specified at the time such service is made available. Details of our current fees are contained, or referred to, on the "Fees Page" of this website. All payments can be made through PayPal, directly from your "Member Area", which is our preferred method, or if you so desire, you can use a credit card. We can also accept cheques or money orders sent to the address given in your "Member Area". Member Communication MinBids provides a public facility which registered Members may use to post questions to each other and to facilitate enjoyable interaction with other registered Members. Reputation Feedback MinBids provides registered Members with the ability to leave comments about their experience in dealing with other registered Members, using the site’s Reputation feedback system. The following actions regarding the use of the Reputation feedback system are prohibited: Threatening another Member with negative feedback for their refusal to perform actions not related to your transaction with that Member or their failure to agree to terms and conditions of an auction that were not stated in the original listing Leaving feedback that contains vulgarity, personal abuse or profanity Leaving feedback that discloses another Member’s personally identifiable information Leaving comments that are negative in nature, through the selection of the Positive comment option MinBids allows you to "Retract" a negative feedback comment that you have left about another registered Member within 30 days from the time you have posted such comment. Retraction is only possible by making an email request to the MindBids administration team. This function should not be misused. Leaving multiple negative comments, and then retracting them, can result in suspension of your registration, membership and account. In the event that your feedback rating should reach the status of 1 your registration and account may be suspended. It is expected that you will use the Reputation feedback system in a manner that upholds and maintains the integrity of the feedback system. 18. Notice All notices given between both parties (You and MinBids) will be made via email, certified mail, or registered mail.
